TERMS AND CONDITIONS:
REFUND, CREDIT, CANCELLATION, AND POSTPONEMENT POLICY
Refunds will only be issued if an event is entirely canceled by The Joffrey Workshop and is not rescheduled. If an event is postponed, rescheduled, relocated, or abbreviated due to circumstances beyond our control—including, but not limited to, instructor illness, travel disruptions, venue changes, acts of nature, or public health considerations—no refunds will be issued. No refunds are offered if a Participant is unable to attend for any reason, including illness, injury, travel complications, schedule conflicts, or personal circumstances. Credits may be offered at the sole discretion of The Joffrey Workshop and are valid for use during one calendar year and are non-transferable. If a Participant is dismissed for any reason, including violations of rules or policies, no refund or credit will be given. There are no exceptions to this policy.
FORCE MAJEURE
The Joffrey Workshop shall not be liable for any delay, interruption, or cancellation of the event due to causes beyond its reasonable control. This includes, but is not limited to, natural disasters, weather events, acts of war, terrorism, civil unrest, government restrictions, public health emergencies, instructor illness, or transportation delays. In such cases, The Joffrey Workshop reserves the right to reschedule, abbreviate, relocate, or modify the format of the workshop. No refunds will be provided under these circumstances.
WAIVER OF LIABILITY, RELEASE, AND HOLD HARMLESS AGREEMENT
In consideration for being allowed to participate in any way in The Joffrey Workshop, including all related events, activities, instruction, and use of premises or equipment, the undersigned Participant and/or Parent or Legal Guardian (if Participant is under 18) agrees as follows:
Assumption of Risk
The undersigned understands and acknowledges that participation in dance training and related physical activities involves inherent risks, including but not limited to sprains, fractures, muscle tears, concussions, overexertion, illness (including contagious disease), or other bodily injury, which may result in permanent disability or death. The undersigned voluntarily assumes all risks, known or unknown, associated with participation in The Joffrey Workshop.
Waiver and Release of Liability
The undersigned hereby waives, releases, and discharges The Joffrey Workshop and/or Bender Performing Arts, and each of their officers, directors, agents, employees, contractors, faculty, and volunteers (“Released Parties”) from any and all claims, liabilities, demands, actions, or causes of action of any kind, whether known or unknown, which arise from or relate to participation in The Joffrey Workshop or use of the Bender Performing Arts premises or equipment, including claims arising from the Released Parties’ own negligence.
Indemnification and Hold Harmless
The undersigned agrees to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, or costs (including attorneys’ fees) that may result from participation in The Joffrey Workshop or from any claims made by third parties related to such participation.
Medical Treatment
The undersigned understands that the Released Parties do not carry or provide medical or accident insurance and agree to be solely responsible for any medical expenses incurred as a result of participation. The undersigned authorizes the Released Parties to obtain medical treatment deemed necessary for the Participant and assumes full responsibility for such treatment and associated costs.
Physical Contact Acknowledgment
The undersigned understands that appropriate physical contact may occur during instruction for the purpose of correction or demonstration and consents to such contact.
Compliance with Rules
The Participant agrees to abide by all rules and regulations of The Joffrey Workshop and the Bender Performing Arts and to comply with all applicable local, state, and federal laws.
Binding Effect
This Agreement shall be binding upon the Participant and/or Parent or Guardian, and their respective heirs, assigns, executors, administrators, and legal representatives. This waiver is intended to be as broad and inclusive as permitted by applicable law. If any part is held invalid, the remainder shall continue in full force and effect.
MEDICAL TREATMENT AUTHORIZATION
The undersigned grants permission to The Joffrey Workshop and/or Bender Performing Arts to administer basic first aid to the Participant in the event of a minor injury or illness.
In case of a medical emergency, the undersigned authorizes The Joffrey Workshop and/or Bender Performing Arts to summon emergency medical personnel and authorize treatment by licensed healthcare professionals. The undersigned acknowledges they will be notified as soon as possible in the event of such an emergency and assumes financial responsibility for any resulting medical care.
TECHNOLOGY POLICY
The Joffrey Workshop encourages a distraction-free experience. Use of cell phones and other electronic devices during class is discouraged.
The Joffrey Workshop and/or Bender Performing Arts is not responsible for the loss, theft, damage, or inappropriate use of personal technology. Any Participant found violating the privacy of others or posting inappropriate material will be subject to immediate dismissal without refund.
IMAGE RELEASE FORM
The undersigned grants The Joffrey Workshop and/or Bender Performing Arts the right to record, use, and publish photographs and video recordings of the Participant in perpetuity, for any lawful purpose including promotional, advertising, or educational uses, in any media now known or later developed.
No compensation will be provided. The undersigned waives any right to inspect or approve the final materials and releases all claims related to the use of such media.
PARTICIPANT BEHAVIOR EXPECTATIONS
Participants are expected to:
Demonstrate respect, responsibility, and maturity at all times.
Refrain from disruptive, inappropriate, or unsafe behavior.
Follow all instructions from faculty and staff.
Infractions may result in removal from class, conferences with a director, and/or dismissal from the workshop without refund. The following are strictly prohibited:
Profanity
Littering, vandalism, graffiti, or property misuse
Tampering with fire or safety equipment
Use of tobacco, alcohol, or illegal drugs
Failure to follow local, state, or federal laws
STUDIO ETIQUETTE
Late arrivals will not be permitted to enter class. Habitual tardiness may result in dismissal.
Adhere to the required dress code. Habitual violations may result in dismissal.
Personal belongings must be kept in bags and out of doorways/hallways per fire code.
Only sealed water containers are allowed. No glass containers.
All trash must be disposed of properly.
Wear street clothes over dancewear when outside the studio.
Always wear shoes outside of class—dance booties are not considered footwear.
By signing below, I acknowledge that I have read, understand, and agree to the terms stated in this Participant Agreement. I understand this document is legally binding and that by signing, I am waiving certain legal rights and agreeing to all conditions outlined above.
