TERMS AND CONDITIONS:
WAIVER of LIABILITY and HOLD HARMLESS AGREEMENT: In the consideration of Relative Motion providing the opportunity for and permitting the Participant to participate and take part in the Relative Motion Workshop and its related activities, the Participant and Parent/Guardian of the Participant, do hereby release, remise and forever discharge, indemnify and agree to HOLD HARMLESS WAIVE, DISCHARGE, and COVENANT NOT TO SUE Relative Motion and/or the partnering dance studio employees, faculty, instructors, hereinafter referred to as RELEASEES, from any claim, demand or cause of action whether now in existence, or hereafter arising for any loss of personal property, illness, or injury to the Participant arising out or resulting from, in whole or in any part by any action or failure to act, negligence, breach of contract, or other misconduct on the part of Relative Motion and partnering studio RELEASEES, any other Participant in said workshop, any parent/guardian, and/or any one or more of any thereof. I/We recognize and acknowledge that while Relative Motion is teaching safe technique and injury preventative training practices, certain risks of harm are or may be inherent in the various activities contemplated herein and that Relative Motion and the partnering studio cannot control all of these risks. I/We are aware that dance training and the athletic exercises associated with it place unusual stress on the body and carry with them the risk of physical injury. I/We assume the risks involved. I/We also understand that dance instruction involves kinetic correction that may include appropriately physically touching the Participant as part of the regular class work and/or rehearsal. I/We assume the risk and agree that Relative Motion has permission to engage in appropriate kinetic correction of the body for technical corrective purposes as part of regular class work and rehearsal. It is my/our express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of my/our family. I/We hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the law. I/WE UNDERSTAND THAT RELATIVE MOTION and partnering studio WILL NOT BE RESPONSIBLE FOR ANY MEDICAL COSTS ASSOCIATED WITH ANY INJURY OR ILLNESS THAT I/WE OR THE PARTICIPANT MAY SUSTAIN. I/We agree that I/We and the Participant will adhere to the rules and regulations promulgated by Relative Motion and obey all laws while participating in this activity.
IMAGE RELEASE FORM: I/We understand and agree that any photo or video of the Participant will become property of Relative Motion and will not be returned. I/We acknowledge that I/We will receive no financial compensation. I/We authorize Relative Motion and partnering studio the authority to edit, alter, copy, publish and distribute images for any lawful purpose. I/We hereby hold harmless and release Relative Motion and patterning studio from all claims, demands, causes or actions for which the Participant or Parent/Guardian or any other person acting on their behalf may be brought against Relative Motion.
TECHNOLOGY POLICY: The Relative Motion Workshop is best experienced without the distraction of technology. We strongly recommend leaving these items at home. Relative Motion and partnering studio will not be responsible for loss, breakage or theft of any items. Additionally, Relative Motion is not responsible for the inappropriate use of technology or for the posting of inappropriate material by Participants, and Participants will be asked to leave the workshop for violating the privacy of others.
MEDICAL TREATMENT AUTHORIZATION: I/We do hereby state that I/We have legal custody of the aforementioned Participant and grant the authorization and consent for Relative Motion and partnering studio to administer general first aid treatment for any minor injuries or illnesses experienced by the Participant during the workshop. If the injury or illness is life threatening or the Participant is in need of emergency treatment, I/We authorize Relative Motion and partnering studio to summon any and all professional emergency personnel to attend, transport, and treat the Participant, and to issue consent for the rendering of such care by authorized members of the hospital staff or their designees, as may be necessary in their professional judgment. I/We understand that I/We will be notified at once in any emergency.
I ACKNOWLEDGE AND REPRESENT THAT I/We have read the foregoing information, understand it and agree voluntarily. I/We execute this documentation for full, adequate, and complete consideration fully intending to be bound by the same.
REFUNDS: Refunds are provided if an event is canceled by Relative Motion. If a student is sent home for any reason, including unacceptable conduct, there is no refund of any kind. There are no exceptions to this policy, regardless of the reason for the withdrawal.
STUDIO ETIQUETTE
- Participants should arrive prior to the start of the posted class time and go immediately to the next class, according to the schedule.
- Participants arriving late for class will not be permitted to join. Habitual tardiness will result in dismissal.
- Participants should be in the required dress code. Habitual improper dress will result in dismissal.
- Participants should keep noise levels to a minimum in the studio and should be prepared to begin class on time, according to the schedule.
- Water is allowed in the studio in a proper, sealable container. No glass containers.
PARTICIPANT BEHAVIOR FORM: Participants of The Relative Motion Workshop are expected to demonstrate high standards of personal behavior and are expected to maintain respectful behavior toward others both in and outside of the classroom. Participants are also expected to accept responsibility for any consequences for mistakes, accidental or intentional. Participants are expected to work to the best of their abilities. If a Participant's class work is unsatisfactory, they will first work with the instructor to resolve the situation. If problems persist, a conference will be scheduled involving the Participant, their instructor, and a Relative Motion director. In the case of continuing difficulties, a director will notify the Participant's Parent/Guardian to discuss solutions. Relative Motion reserves the right to dismiss a Participant, without refund, at the expense of the Parent/Guardian, for lack of effort, for disruptive behavior in class, or for any infraction of the rules and regulations. Additionally, the use of profanity is prohibited. I/We and the Participant understand and agree to the behavioral requirements that have been listed above and agree to obey all local, state and U.S. federal laws.
